Special Education in County Schools Education is a fundamental right of all students. The academic, social and job-related skills students developed through public elementary and secondary programs enable them to become engaged, productive citizens of our state and nation. Protecting the educational rights of all students is an important responsibility of schools and families, requiring active and effective participation of parents, and students when appropriate, in educational decision making. Students whose educational needs are affected by an exceptionality receive protections under federal and state laws and policy. When an exceptional student’s individual needs require significant changes in educational services from those the student otherwise would receive, parents have the right to participate in meetings in which decisions are made, receive notice of any changes to the student’s educational program and services and give consent for major changes. Tucker County Board of Education’s special education programs provides a free and appropriate public education for all students, ages 3-21, who have been determined eligible in one or more of the following areas: Preschool handicapped; mentally impaired; hearing impaired; physically handicapped; learning disabled; behaviorally disorder; visually impaired; communication disordered; deaf-blind; gifted; and/or autistic. Students suspected of needing special programs or services including children not yet enrolled in school may be referred by teachers, parents, or agencies to the school’s Student Assistance Team (SAT) by calling the school principal. The (SAT) Team will develop intervention strategies to utilize with the student so that a determination can be made regarding the student’s referral for special education evaluations. If an assessment is to be conducted, the parent(s) or guardian will be contacted by the school system to obtain written permission before any assessment is initiated. After the Assessment is completed, a meeting will be held to discuss the results. If the student is eligible for services and if the parents agree, an individualized education plan (IEP) will be written describing the special programming and services that the student will be receiving. Many students require a minimum of assistance to achieve their goals and may be phased out of the special education program while others may require assistance throughout their entire school career. Parental support is always important and is needed to develop a successful program for students. Extended school year services are also provided for special needs students who qualify. Procedural safeguards are also available that outline the parent’s right to participate in the special education process and options when the parent and school personnel do not agree. This information is provided to facilitate parent participation and to ensure procedural safeguards are available to parents and their exceptional students .
